There is a whole field of research on "false memories" with obviously critical implications in criminal psychology (not my research field)... even if our thoughts and memories would be open to technology and made available, those could contain stuff that is almost completely made up by mistaken connections and glitchy brain electrochemistry. This is a known phenomenon especially in cases of mistaken recognition (and punishment) of crime suspects by witnesses, who felt sure they saw someone committing crimes although they never actually saw the specific suspect doing it. Towards the end you mentioned something pretty close to this :)

34:00 "your brain wants this" is basically advertising to addicts (donuts sure, but also gambling, alcohol, smoking etc)

Anyone see the Black Mirror episode "Crocodile?" People are compelled to have their brain scanned for criminal thoughts and witness testimony.

14:00 taking photos and not sharing them feels the same as keeping a private journal. It's just for me

One of my big concerns about thought-reading with the legal system would be how it interacts with basically any mental illness. Imagine you have Tourettes, or OCD, or even intrusive thoughts from ADHD/Autism. Hell even neurotypical people have plenty of intrusive thoughts sometimes, most people have had the experience of walking over a sheer drop and briefly thinking "what if I jumped" despite having zero desire to jump and no suicidal tendencies. I just don't think it could be fundamentally useful to investigations without also being massively biased against people with mental health issues.

Please do an episode about aphantasia.

Aphantasia describes the lack of pictorgaphic memory (together with potentially the inability to recall smells, feelings, sounds (like your parents voice for example). Its a spectrum with many people falling somewhere in the middle. I have full aphantasia (no images, smells, ability to recall sounds or the ability to imagine how it would feel to touch a surface or myself) and i did not know until i was an adult.
Additionally, funny enough, my girlfriend has no internal monologue (a hole other can of worms) so how would our potential children think?

Love the podcast, thank you both so much ❤

This makes me wonder: Do government structures and laws created 100s of years ago based on their values, culture, and technological life style still reflect our modern day values, culture, and technological life style? Sometimes it feels like more has changed in the past 200yrs then then the last 10,000 prior.

This is such an important topic! Privacy is massively endangered in the modern era.

I've been reading 1984 recently, it seems to be more and more relevant these days.

If you lie to wrongfully convict someone, you should serve the sentence born of the lie.

There’s an anime called Psycho-Pass that explores a society where people are arrested based on the analysis that they COULD commit a crime.

1:00 this is why on an iPhone you can just click the power button five times, whether the phone is open or locked already, to temporarily disable FaceID. Passcode will be needed to get into it again. Useful tip if you are about to get arrested or similar

Pressing the side/power button 5 times on an iPhone triggers the Emergency SOS feature. Once you cancel this screen, your iPhone will be forced to require the passcode to unlock. You can do it with your phone in your pocket.

The thing about the school detecting when a student was not focused/day dreaming is my idea of a hellish nightmare. Daydreaming was all that got me through the tedium of school. Honestly. I honestly think that kind of environment would have made me suicidal.
