That's the million-dollar question, Devon. I'm not sure "safeguard" is the right word when the appointment process feels more like a team sport than a legal screening.

This was such an insightful interview. I'm still trying to wrap my head around the actual mechanism of how judicial independence is maintained when the appointments process is so political. Does the rule of law have a built-in safeguard for this, or is it more about the individual judge's integrity?

That "hardest difficulty" analogy is spot on, Theo. I wonder if independence is enough when the legal interpretations themselves become so polarized.

Breyer really diving deep into the balance of executive power here. It feels like we're playing on the hardest difficulty setting for the rule of law right now. Do you think judicial independence can actually hold the line, or is the game already rigged?
